Terms of Service & Disclaimer

LandFirst reports are opinions based on available data, prepared for informational and educational purposes only. They do not constitute financial, investment, legal, tax, or real estate advice. You should not rely on a LandFirst report as the sole basis for any property purchase, sale, or investment decision.

1. Nature of Service

LandFirst provides analytical framework reports that evaluate residential properties using a land-first investment methodology. Each report represents the opinion and analysis of the report author based on publicly available data, third-party sources, and analytical frameworks at the time of preparation.

LandFirst is not a licensed real estate brokerage, valuation firm, appraisal firm, financial advisory firm, or legal practice in any jurisdiction. We do not hold professional licenses in real estate, financial planning, law, surveying, or building inspection in any country, state, or territory.

2. Not Professional Advice

LandFirst reports do not constitute and should not be interpreted as:

  • Financial or investment advice
  • Licensed property valuations, appraisals, or formal opinions of value
  • Legal advice regarding zoning, planning, property rights, or title
  • Tax advice or tax planning guidance
  • Recommendations to buy, sell, hold, or avoid any specific property
  • Guarantees or predictions of future property value, rental income, capital growth, or investment returns
  • Building, engineering, or structural assessments
  • Environmental or contamination assessments

Always consult qualified, licensed professionals — including real estate agents, licensed appraisers/valuers, property lawyers/solicitors/conveyancers, financial advisors, building and pest inspectors, environmental assessors, surveyors, and tax professionals — before making any property decision. Requirements for professional licensing vary by jurisdiction.

3. Accuracy and Completeness

While we endeavor to provide useful analysis, LandFirst does not guarantee the accuracy, completeness, reliability, currency, or timeliness of any information, data, score, rating, or conclusion contained in our reports. Our analysis is based on:

  • Publicly available data that may be outdated, incomplete, or contain errors
  • Third-party data sources whose accuracy we cannot independently verify
  • Analytical frameworks that involve subjective judgment, assumptions, and opinion
  • Information available at the time of report preparation, which may change at any time without notice

Property markets are inherently complex and unpredictable. Data about zoning, school districts, comparable sales, planning regulations, building conditions, environmental factors, and market trends can change without notice. No analytical report can fully capture or predict all factors that affect property value or investment outcomes.

Scores and ratings in our reports (e.g., "7/10" or "High Risk") are subjective opinions, not objective measurements. Different analysts reviewing the same property may reach different conclusions. A high score does not mean a property is a good investment for you, and a low score does not mean it should be avoided.

4. No Physical Inspection

LandFirst reports are desktop analyses only. We do not conduct physical inspections of properties, buildings, land, or surrounding areas in any jurisdiction. Our reports cannot identify or assess:

  • Structural defects, building code violations, or safety hazards
  • Environmental contamination, asbestos, lead paint, mold, or hazardous materials
  • Hidden property defects not apparent from public records or satellite imagery
  • Boundary disputes, easements, encroachments, or rights of way not recorded in publicly available data
  • Actual condition of roofing, plumbing, electrical, HVAC, foundation, or other building systems
  • Pest, termite, or vermin damage
  • Flood risk, bushfire risk, soil stability, subsidence, or geological hazards beyond publicly available mapping data
  • Heritage, conservation, or protected status restrictions not reflected in publicly available planning data
  • Noise, odor, traffic, or other environmental amenity factors that require on-site assessment
  • Native title, indigenous land rights, or cultural heritage obligations (where applicable)

You must arrange independent physical inspections and professional assessments appropriate to your jurisdiction before making any property purchase decision.

5. Risk Disclosure

Real estate investment involves substantial risks including but not limited to:

  • Loss of part or all of invested capital due to market decline or property-specific issues
  • Illiquidity — inability to sell at the desired price or within your required timeframe
  • Unexpected renovation, maintenance, remediation, or compliance costs substantially exceeding estimates
  • Changes in zoning, planning regulations, government policy, or tax law
  • Interest rate changes affecting mortgage costs, borrowing capacity, and property values
  • Economic downturns, employment market changes, or demographic shifts
  • Natural disasters, climate-related events, or environmental changes
  • Changes in school district boundaries, catchment areas, ratings, or educational quality
  • Infrastructure changes that positively or negatively affect property values
  • Currency exchange rate fluctuations (for cross-border investors)

Past property performance, historical trends, and current market conditions do not guarantee future results. Your personal financial situation, risk tolerance, investment goals, tax position, and circumstances are unique and are not considered in our reports.

6. Limitation of Liability

To the maximum extent permitted by applicable law in your jurisdiction:

  • LandFirst, its owners, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to the use of, or reliance on, any LandFirst report.
  • This includes, without limitation, damages arising from property purchase or sale decisions, investment losses, renovation cost overruns, planning application failures, inaccurate data, omissions, missed risks, or any other outcome related to actions taken or not taken based on our reports.
  • Our total aggregate liability for any and all claims arising from the service shall not exceed the amount you paid for the specific report in question.

Important notice for Australian, New Zealand, and UK customers: Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), the New Zealand Consumer Guarantees Act 1993, the UK Consumer Rights Act 2015, or any other mandatory consumer protection law that cannot be excluded by agreement. Where such laws apply, our liability is limited to the maximum extent permitted, which may include re-supplying the service or refunding the price paid.

7. Indemnification

You agree to indemnify and hold harmless LandFirst, its owners, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Your redistribution, resale, or unauthorized sharing of reports
  • Any misrepresentation of our reports as licensed appraisals, valuations, or professional advice

This indemnification does not apply to the extent that a claim arises from our negligence or breach of these Terms.

8. No Warranty

To the maximum extent permitted by applicable law, reports are provided "as is" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. This clause is subject to any mandatory consumer guarantees that cannot be excluded in your jurisdiction (see Section 6).

9. Your Responsibilities

By purchasing a LandFirst report, you acknowledge and agree that:

  • You are at least 18 years of age (or the age of majority in your jurisdiction)
  • You are solely responsible for your own property and investment decisions
  • You will conduct your own independent due diligence before acting on any information in the report
  • You will engage qualified, licensed professionals appropriate to your jurisdiction before making any property transaction
  • You understand that the report is one opinion among many inputs that should inform your decision, not the sole or primary basis for it
  • You will not treat scores, ratings, or assessments as guarantees, promises, or predictions of outcomes
  • You understand that local regulations, market conditions, and data availability vary by jurisdiction and may affect the depth and applicability of the analysis

10. Cancellation and Refund Policy

Before report delivery: You may cancel your order and receive a full refund at any time before the report has been delivered to your email address. To cancel, contact us at support@landfirst.ai.

After report delivery: If we deliver a report that does not substantially address the property you requested (for example, due to a data error on our part, or analysis of the wrong address), we will either re-deliver a corrected report or issue a full refund at your choice.

If we are unable to produce a meaningful analysis for the address you provide (for example, due to insufficient publicly available data in that jurisdiction), we will notify you and issue a full refund.

Disagreement with our analysis, opinions, scores, or conclusions does not constitute grounds for a refund, as the report represents our analytical opinion which may differ from other assessments.

For Australian and New Zealand customers: These refund terms are in addition to, and do not limit, any rights you may have under the Australian Consumer Law or New Zealand Consumer Guarantees Act if the service fails to meet a consumer guarantee.

11. Intellectual Property

All reports, frameworks, methodologies, and content are the intellectual property of LandFirst. Reports are licensed for your personal, non-commercial use only. You may not redistribute, resell, publish, sublicense, or share reports with third parties without prior written permission. You may share excerpts with your professional advisors (e.g., lawyer, financial advisor, building inspector) for the purpose of obtaining their advice on the specific property.

12. Privacy and Data Protection

We collect the following personal information to deliver our service:

  • Your email address (to deliver the report)
  • Your name (if provided, optional)
  • The property address you submit for analysis

How we use your data: We use your personal information solely to prepare and deliver the requested report, process your payment, and communicate with you about your order. We do not use your data for marketing purposes unless you separately opt in.

Data sharing: We do not sell or rent your personal information to third parties. Payment processing is handled by Stripe, Inc. and is subject to Stripe's privacy policy. Form submissions are processed by Formspree and are subject to Formspree's privacy policy.

Data retention: We retain your personal information and report data for up to 24 months after delivery to handle any follow-up questions or disputes. After this period, data is deleted unless retention is required by law.

Your rights: Depending on your jurisdiction, you may have the right to access, correct, delete, or port your personal data. To exercise any of these rights, contact us at support@landfirst.ai. We will respond within 30 days.

Cross-border data transfer: Your personal information may be processed in the United States, where our service operates. By using our service, you acknowledge that your data may be transferred to and processed in the United States, which may have different data protection laws than your country of residence.

13. Dispute Resolution

If you have a dispute or concern about a LandFirst report or service, we encourage you to contact us first at support@landfirst.ai. We will make reasonable efforts to resolve your concern informally within 14 days.

If informal resolution is unsuccessful, any dispute arising from or relating to these Terms or our service shall be resolved as follows:

  • For US-based customers: Disputes shall be governed by the laws of the State of California and resolved in the courts of San Mateo County, California.
  • For Australian customers: Nothing in these Terms limits your right to bring a complaint to the ACCC or your state/territory fair trading office, or to pursue remedies under the Australian Consumer Law.
  • For New Zealand customers: Nothing in these Terms limits your right to bring a claim to the Disputes Tribunal or pursue remedies under the Consumer Guarantees Act.
  • For UK customers: Nothing in these Terms limits your right to bring a complaint to Trading Standards or pursue remedies under the Consumer Rights Act 2015.
  • For Canadian customers: Nothing in these Terms limits your right to pursue remedies under applicable provincial consumer protection legislation.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law provisions. However, this choice of law does not deprive you of the protection afforded by mandatory consumer protection laws of your country or jurisdiction of residence that cannot be derogated from by agreement.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

16. Changes to Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated via email to customers who have purchased reports within the preceding 12 months. Continued use of our service after changes constitutes acceptance of the updated Terms. The version of the Terms in effect at the time of your purchase applies to that transaction.
